Since the year 2017, Colombia officially accepted the same sex marriage-gay marriage and despite all the controversial arguments that some conservative authorities and people have about it, The Colombian Constitutional Court was clear that there is no restriction for same sex couple to get civil marriage or what is called in popular words gay marriage.
As consequence, the requirements for a foreign who is getting married with a Colombian citizen are the following.
- Birth certificate with apostilled and certified translation into Spanish
- Divorce documents from any previous marriage
- Certificate of non-prohibition to get married.
- Copy of passport
- Copy of immigration stamp
- Petition for marriage signed.
You can provide power of attorney to anyone in Colombia to file and represent you for the marriage. This power of attorney should be notarize and apostilled.
If you decide to sign prenuptial, they must be prepared and filed before the marriage. There is no post nuptial agreement.
All documents must be less than 90days old and translated into Spanish.
We recommend that you as foreign hire an attorney, the process can be difficult because the burocracy and paperwork to be file and if it is done incorrectly, later an annulment can be issued.
Also, for your Colombian spousal, the conditions depends if there are children or not from previous relationships, if the answer is yes, a court license will be required.
