In my 17 years of experience as Colombian attorney this is a very common question, I got asked by my US clients who residents in Colombia are not and need to get divorce regarding if it is possible.
My answer is Yes and depends in these terms.
- Agreement divorce. Because the law 962 authorized the divorce without parties being in Colombia, there is no requirement or prohibition to sign the Colombian divorce.
This option allows your lawyer to do the process with the notarized documents you need to send him.
I always consider best divorce in terms of time, stress, and expenses.
- Divorce in Colombia court as a US citizen without residence.
Well, this is trickier. One part is that if Colombian party lives in Colombia, that would be the city in which to file the divorce and you don’t need to have US residence in Colombia.
On the other side, if no party lives in Colombia and there is a legal case, each state has different regulations.
Some States allow you to get divorce without having residence but other ask you for a time in Colombia. Even some weeks. This is part of how good the lawyer is and his experience in procedure law and family litigation.
- US citizen living in US and Colombian wife is missing or no one where she is.
In this type of case, it is possible to file the divorce in Colombia without you as US citizen having residence in Colombia.
