One of the most important obligations of a lawyer is to keep updated in regulation and laws. In this specific article, I will write about the recent 2023 and 2024 news of the divorce in Colombia. Please feel free to contact me for more information or a consultation. Every story and evidence are different in terms of a Colombian divorce. I have 17 years of experience dealing with the divorce in Colombia.
DIVORCE COLOMBIA NEWS -SUMMARY
- For the mutual agreement the news about Colombian divorce is:
The process still the same. Some notaries have decided because the apostille delay times in USA, to avoid asking birth certificate of the US client with apostille. This exemption is based on each case and sole discretion of Colombian notary.
Still, power of attorney notarized and with apostille or seal of Colombian consulate is mandatory.
- For the trial divorce in Colombia when US citizens are involved, the hearings are always done online. No more personal hearings in Colombia and no need to be here to proceed with the lawsuit.
Your Colombian attorney should provide all documents to sign and notarize to file the divorce.
- Separation with Colombian wife for more than 2 years. The date of judgment now indicates the date of physical separation as the date of divorce and not the date in which court issued the divorce decree.
- In case of domestic abuse, women because gender policy, will be evaluated with more priority than other cases and evidence will be taken into more consideration when woman is affected. I suggest to all US clients avoid confrontation and better file a petition for restriction against wife and permission to leave home with the court.
- Judgement or Colombian divorce decrees will be in pdf form, nothing more in paper. It will be emailed to you after court has adjudicated the case.
- Divorce won’t be final until the divorce decree has been noted in your Colombian marriage certificate.
I understand that each case is different, and as a US citizen may have questions about the process and its requirements and what to do.
Please feel free to contact me for further information.
