Lately, we have noticed in our law firm an increase on the number of US clients who have asked us to provide legal representation in Colombia for cases of illegally child abduction whose cause have been in USA.
Each case is different; however as lawyers we have found out that the US courts orders don’t operate directly in Colombia and they have to follow a path with US state department and Colombia central office along with Colombian courts system to make them valid.
This legal procedure takes time and a lot of forms and hearings to attend, along with a strong evidence to be provided to the Colombian court in order to accept that child needs to return to his home country and has a better live there and the more important that child wont loose contact with the Colombian mother.
In this process, we have been able to appreciate a difficulty in the litigation and is when one of the parents is Colombia, especially the mother. This fact makes Colombian family court more negative to order the return of the child to his home country, also because the child being his mother Colombian, has the right to Colombian citizenship and more likely judges don’t want to separate child from mother.
