Colombia express divorce was created by the law 965 of 2005 in which the law authorized the notary to perform an express divorce in Colombia only when couples agreed in the divorce, alimony, liquidation of assets and if there were children the child support and custody regulation.
The Colombian divorce before 2005 was only done in family court and even in case of mutual agreement could take months, but with the new law back in 2005 the idea of Colombian express divorce in 2 hours was how it was promoting.
Now, after in 18 years later I can tell as Colombian attorney it is impossible to have a divorce in a couple of hours and even in the same day. After covid impacted legal process and the amount of paperwork required for express divorce now we can tell how much it takes to have a divorce.
Here is an expected current time for an express divorce in Colombia year 2024.
Express divorce-mutual agreement no children no assets 30 days.
Express divorce-mutual agreement children and no assets 30 to 60 days. It depends on the social worker assigned to accept the agreement regarding children and the city in which divorce was filled.
Express divorce-mutual agreement children and assets. From 60 to 90 days. It depends on the social worker assigned to accept the agreement regarding children and the city in which divorce was filled plus the time of property records office to study and register the liquidation of assets.
This express divorce or mutual agreement divorce can be done even if one or both spouses are outside Colombia and there is no need for hearings or to appear in Colombia.
I have 17 years of experience as divorce attorney in Colombia and I am the author of civil marriage book.
