One of the most common question we have received in our office in the recent years is about if the client got married in Colombia but got divorced in US , is the US divorce good to get married again.
The answer is No, a divorce obtained in US for a marriage in Colombia DOESN’T END the marriage in Colombia. You still married here and your marriage record still active.
Now, what to do if your are in the situation. Each state of US and each divorce is different, however we have 3 alternatives
- Proceed with a homologation of the US divorce with the Supreme Court of Colombia. It is a process that requires legal and evidence technique plus takes time and involve higher fees than option 2 and 3.
- File a new lawsuit of divorce with a family Colombia court. This requires the lawyer to review the US divorce and see what’s the status of evidence and cause of divorce in order to file the divorce with Colombian family court.
- File a non contested or mutual agreement divorce. Best option, takes around 30 days but requires the signature of both partners of all documents and agreement of divorce, also agreement for child regulation and properties. ( if there is no agreement in one part, it can’t be done)
