The landmark 2016 ruling by the Colombian Constitutional Court established that same-sex couples are entitled to the same legal protections and obligations as heterosexual couples, including the right to marry and divorce.<\/p>\n<p>The Colombian Civil Code, particularly Article 154, governs marriage dissolution and applies equally to all married couples, regardless of sexual orientation. The grounds for divorce remain classified into two categories: absolute and relative.<\/p>\n<p>Absolute grounds include:<\/p>\n<ul>\n<li>Mutual consent of both spouses.<\/li>\n<li>Permanent separation for at least two years.<\/li>\n<li>Adultery.<\/li>\n<li>Physical or psychological abuse.<\/li>\n<li>Substance addiction or intoxication of one spouse.<\/li>\n<\/ul>\n<p>Relative grounds involve more nuanced issues, such as betrayal, breach of trust, or conduct that significantly affects the marriage.<\/p>\n<p>Divorce Procedures for Same-Sex Couples<\/p>\n<p>The divorce process in Colombia has become more straightforward but still varies depending on whether it is by mutual agreement or contested.<\/p>\n<p>Mutual Consent Divorce<\/p>\n<p>This is the simplest route. Both partners agree to dissolve the marriage and jointly prepare a divorce agreement. This document outlines the division of assets, custody arrangements (if applicable), and alimony provisions. The parties submit these documents to the family court, which reviews and approves the agreement.<\/p>\n<p>Contested Divorce<\/p>\n<p>If one partner opposes the divorce or disputes its terms, the process becomes more complex. The initiating spouse files a formal petition in court, citing lawful grounds for divorce. The court schedules hearings for both parties to present evidence and arguments. Ultimately, the judge determines whether to grant the divorce and under what conditions.<\/p>\n<p>Child Custody and Support custody disputes may be complicated by traditional views on parenting, which might not fully recognize parenting roles within same-sex relationships.
