Because\u00a0<\/span>of several questions about WILLS, ESTATES, AND\u00a0<\/span>THE\u00a0<\/span>INHERITANCE<\/span>\u00a0processes<\/span>\u00a0in Colombia<\/span>,\u00a0<\/span>I<\/span>\u00a0have<\/span>\u00a0decided to\u00a0<\/span>comment\u00a0<\/span>about the\u00a0<\/span>t<\/span>opic to illustrate<\/span>\u00a0<\/span>TO all client of\u00a0<\/span>how Colombian laws<\/span>\u00a0deal<\/span>\u00a0with this matter<\/span>.<\/span>\u00a0<\/span><\/p>\n

Succession<\/span>\u00a0or\u00a0<\/span>Inheritance<\/span>\u00a0laws\u00a0<\/span>for foreign citizens<\/span>\u00a0<\/span><\/p>\n

\u00a0<\/span>There are two\u00a0<\/span>ways<\/span>\u00a0to study it.<\/span>\u00a0<\/span><\/p>\n

  1. a) The death of<\/span>a<\/span>foreign citizen.<\/span>\u00a0<\/span><\/li>\n
  2. b)<\/span>When<\/span>the foreign citizens receive a legacy.<\/span>\u00a0(<\/span>Inheritance<\/span>)<\/span>\u00a0<\/span><\/li>\n<\/ol>\n

    1. a) In the first case, the article 1054 of the Colombian civil code states that in the succession<\/span>\/estate<\/span>of a foreign citizen, the Colombian people have the right to<\/span>inherit<\/span>,<\/span>\u00a0including the<\/span>\u00a0<\/span>right to<\/span>\u00a0ask for food<\/span>,\u00a0<\/span>support and<\/span>\u00a0a legal right to part of the assets. (<\/span>Example<\/span>: wife has no means of support following the death of her spouse)<\/span>\u00a0<\/span><\/li>\n<\/ol>\n

      When the foreign\u00a0<\/span>citizen dies<\/span>\u00a0outside Colombia but he has assets inside this nation<\/span>\u00a0(Colombia)<\/span>, the\u00a0<\/span>succession<\/span>\u00a0process will be ruled by\u00a0<\/span>Colombia\u2019s<\/span>\u00a0laws<\/span>\u00a0and not by the foreign citizens home country<\/span>\u00a0ONLY FOR THE ASSETS LOCATED IN COLOMBIA<\/span>.<\/span>\u00a0<\/span><\/p>\n

      The place where the\u00a0<\/span>succession<\/span>\u00a0process will be opened is his\/her last address in\u00a0<\/span>Colombia<\/span>. Of course, the non nationals have the same rights as Colombians beneficiaries but in practice there may be trouble.\u00a0<\/span>\u00a0<\/span><\/p>\n

      \u00a0<\/span><\/p>\n

      1. b) The foreign citizen as beneficiary in a succession<\/span>\/inheritance<\/span><\/li>\n<\/ol>\n

        \u00a0<\/span><\/p>\n

        The\u00a0<\/span>article<\/span>\u00a01053 of the civil code orders that Colombians and foreign<\/span>ers<\/span>\u00a0have the same rights<\/span>, and must accomplish the same duties that the law orders.<\/span>\u00a0<\/span><\/p>\n

        In practice when a foreign citizen dies and he\/she has assets in\u00a0<\/span>Colombia<\/span>\u00a0and in other countries, there are 2 succession process<\/span>es<\/span>\u00a0opened under the law of the nation where the goods are located.<\/span>\u00a0<\/span><\/p>\n
