During my 18 years of experience as attorney, I have seen a lot of questions regarding the annulment procedure for marriages done in Colombia.
The first thing that we need to have clear is that depending on the type of marriage, there is a way to get an annulment.
Catholic marriage: The annulment is done with the catholic courts, and it can be only started once you have your divorce with the family courts. Not directly the annulment without the judgement of the family court. Things such as child support, alimony and division of property should be already set before starting the annulment.
The catholic courts review the lawsuit for annulment if found, the marriage is voided.
Once you have the judgment of the catholic court, your attorney needs to file a process with the family courts to homologate the catholic ruling and then once family courts accepts the annulment, the marriage is annulled.
Civil marriage: it is done directly by the family court and depends on several causes. The most common is the existence of previous marriage without divorce, but lately we have started to see, annulments because the lack of intention of marriage by one of the partners. In example, she was looking for the US visa but never wanted to live with the other mate.
The annulment cancels the marriage, and you will be back to being single as if you never got married except for children, who still appears as children born under the marriage.
The innocent party can claim also for a compensation because the damages occurred based on the ground of annulment.
