My United States clients have asked to prepare a youtube video regarding of how the non contested divorce is done in Colombia.
Here is a brief explanation of the law but it is important that you hire an experienced lawyer to represent you in order to avoid delays or denials.
According to the law 962 of 2005, Colombia authorized a mutually approved divorce with a notary when the couple agrees on the terms of the divorce. This option was created as a tool to avoid the procedure in court, which always takes time and is more expensive.
A normal divorce when the couples agree on the terms a minimum of two days is required using the notary. This is when the couple doesn’t have kids or assets, plus another week to register the public document at the notaries where the marriage and birth certificates are recorded.
In case there are children, the mutual agreement divorce can take up to 30 days because the social worker ICBF has to provide “a concept of the section of child rights and agreement”, plus when the couple has assets, the liquidation of the community property must be done at the notary and then registered in the office of public records.
The express divorce process can be used by persons living outside of Colombia, but the preparation of the documents for the divorce must be made by an experienced lawyer who knows what and how to request and write the legal papers in order to get them approved by the foreign authority and then by Colombian notary.
