US clients has been asking lately a legally representation to obtain the divorce of their Colombian marriage once the US visa for their Colombian wife was denied. US government in the head of UCSIS denies the visa; there is much option that ends the marriage.
In my experience, I have found to possible ways
- Non contested divorce. US party and Colombian party understands that there is no way back after a denial and they decide to finish the marriage. Clients sign the agreement of divorce and I represent them in the divorce.
- Contested divorce: normally is the Colombian party that asks for alimony to support her life because the new situation the US visa denial. I have seen petition for large amounts that makes the client go to court to trial divorce. Once in court, with my representation, alimony is reducing to logic amounts and even dismiss based on the evidence.
Important, not obtaining a divorce, and just don’t talk to the Colombian wife anymore, doesn’t finish the marriage or a US divorce is not valid for a Colombian marriage.
