One of the most common questions asked by our clients is if we can provide a day when his Colombian divorce is going to be finished or if the express divorce in Colombia still exists in 2023. By law, we can not provide an exact day, but our large experience of more than 18 years has made us learnt an approximate time.

Colombia Non contested divorce. No children no assets

From the moment we file documents until the signature of divorce max 30 days. Depends on the city and notary or court.

Colombia Non contested divorce with children and assets.

From the moment we file documents until the signature of divorce max 60 days. It can be extended around 30 days if social worker ICBF requests additional information over the agreement of children plus registration of liquidation of assets.

Colombia Trial divorce.

By law the max is 1 years in family court and 6 months in appeal. However, all depends on the type of divorce, cause, and court agenda, including the jurisdiction of the court.

Courts in main cities as Bogota, Medellin, Cali, or Cartagena takes longer compared to a family court in a small town (from personal experience around 4 months).

There are factors that could extend the process, such as witness availability, expert reports, banks reports, liens, or other factors such as certified translator agenda, lack of communication etc.
