How to amend a Colombia birth or marriage record in 2023

One common situation I see nowadays as a Colombia attorney is that during the estate process, clients show me their Colombian birth or marriage records and when I look at them, I see common mistakes.

Here are some of them and actions to take.

  1. Name in the Colombia birth is different spelled compared to his ID. On key is different, John is written as Jhon.

This is very common. Depending on the court and purpose of the birth certificate, it can be amended in a simple public document.

  1. Name of client in the Colombia birth certificate is incomplete, there is a difference between name in birth certificate and ID. For example, his name is Jesus Alberto del Socorro, but the ID shows only Jesus.

Sometimes it requires a public document and new Colombia ID.

  1. Name order is changed in the Colombian birth certificate, from first name to middle name: For example, his real name is Carlos Jose, and the written name is Jose Carlos.

  1. One very common and difficult to fix that sometimes needs catholic records and family court, it is the date of birth. Back in the old days, that everything was handwritten, is usual to find Colombian birth certificates with incorrect date of births.

This one is difficult, most of the times, requires a court judgment that gives clarity when the real birth certificate was, especially when there are Colombia estates involved.

  1. Date of birth different in the ID compared to the birth certificate. Common mistake also, it requires a process to change and update both documents.

With the certified birth certificate sometimes records accept to produce a new ID, other situations, requires court judgment authorizing the new ID.

  1. Marital Status: it is mandatory in Colombia that the marriages are registered on the back of the birth certificate of each spousal, however before 2021, the notice of weeding was sent by regular mail to the records office in which the birth certificates were kept, but of course, mail never got there, mail got there and officer quit, office put the mail in a box and forgot about it. I have seen many stories during my 17 years as Colombian lawyer.

It is possible to fix but takes some time and there are fees involved and the need to register and sign books.

  1. Misspell in names, numbers of ID´s, and witness names. It does require a public document.
