One of most common questions asked by clients is that they got married in Colombia with their ex Colombian wife and got divorced in USA. Years later, they want to get married again with a foreign spousal and UCSIS rejects the US visa because US client still married in Colombia and clients can’t understand why if they have their US divorce.

Well, according to Colombia civil code and the current 2023 courts decision in Colombia, the marriage in Colombia does not end with a US divorce, this process requires that after the US divorce has been finished and if it followed certain rules, be filed again with the Supreme Court of Colombia.

The process is called exequatur, and it is taking no less than 2 years and it has considerable fees.

Now, we have suggested to clients to look for other options such as a new divorce in Colombia (mutual or non-contested divorce) and worst case a Colombia trial divorce.

I receive at least 2 clients per week with same situation and all of them have got their Colombian divorce and UCSIS has approved it.
