Colombia legislation can issue two types of divorce decree but because US citizens are not familiar with the type and form of a Colombian divorce decree, here are some notes about it.

  1. Divorce decree in Colombia when the process was done of Colombian divorce was done with a notary.

Your Colombian lawyer and the notary will sign a public document in sealed government pages, which will be called a non-contested divorce or mutual agreement Colombian divorce.

This public paper will be registered with the notary that registered your marriage in Colombia.

The divorce decree in Colombia done in notary will contain the identification of parties, the story of marriage, the cause as mutual agreement divorce and the agreement regarding alimony, children, and property.

  1. Divorce decree in Colombia when process of Colombian divorce was done in Colombia family court.

The judge will be the only person signing the divorce. It was possible before 2020, that all parties involved in the divorce needed to sign the divorce decree, now it is not.

The Colombian divorce judicial decree contains in general terms.

Identification of the Colombian court and parties.

Story of marriage.

Analysis of the ground of divorce and evidence.

Consideration of the court to grant or not the divorce.

Decision.

This Colombia divorce decree is sent by the court to the office in which the marriage is registered.

  1. Legalization of Colombian divorce decree for international use.

Depending on the type of Colombian divorce decree, it follows certain rules before it can be legalized with your embassy to have international effect. Please feel free without cost to send me an email to help understand your situation and type of divorce and the process to follow,

  1. After 2021 divorces decrees are electronic but before that date everything was in paper and nothing digital.

I understand that each case is different, and the US citizen may have questions about the process and its requirements.

If you need copy of your Colombia divorce decree for international purposes, please feel free to contact me for further information.
