Despite Bigamy is NOT criminal offense in Colombia and is NOT punishable by law since 2001. The practice of bigamy, which involves being married to more than one person at the same time, is considered unethical and against the principles of marriage and family and it will be criminal prosecuted as a fraud and falsification of civil status.
According to Colombian law, a person who enters into a second marriage while still legally married to another person is not committing bigamy HOWEVER this second marriage can be annulled by any person with a legal interests such as innocent party, beneficiaries of an estate, or previous wife.
This offense of entering to a second marriage while having a previous one is punishable by imprisonment and fines because it was done under false identification of civil status and sign the marriage form as single involves a fraud. In addition, any subsequent marriages entered by a bigamist are considered invalid and the innocent party has the right to compensation.
