Recently the supreme court of Colombia ruled a new interpretation regarding the debts obtained during marriage. The new regulation states that all debts acquired during marriage in Colombia and at the moment of the divorce are presumed as social debts.
This means that debt will be split 50 and 50 between each party of divorce.
This changed the old interpretation and makes the liquidation of assets during a divorce easier for parties. In example, if there was a purchase of a credit to pay for a family vacation trip, this debt is the new interpretation should be split 50 and 50, in the previous and removed interpretation, the debt was in charge of the owner of the credit card or the signer of the contract.
