17 years ago I started representing US clients who stopped living with their Colombia wives for more than 2 years or that they never lived together after marriage in Colombia and now the US clients want to get the Colombian divorce.
Regarding this type of case, I recommend always talking to the Colombian wife and looking for a mutual agreement or non-contested divorce, it takes around 30 days maximum and the paperwork, legal and government fees are way less than a trial divorce in Colombia family court.
Now, if there is no agreement, only solution is a trial divorce in Colombia family court under the cause of separation of more than 2 years. If this is the cause, a trial divorce same as the US court procedure should take.
Judge will interview both parties, witnesses and evidence and verify if the cause of more than 2 years of non-living together is met by plaintiff.
If condition of non-living together for more than 2 years in Colombia is met, judge will grant the divorce and order the registration in the marriage Colombia act.
There is not AUTOMATIC DIVORCE in Colombia when couple has not lived together. This is false conception
Colombia judge always will be the one who orders the dissolution of marriage for the cause of separation of more than 2 years.
